Anthem has agreed to pay the federal government $16 million in a settlement over a data breach. This HIPAA settlement is the largest in history.
Failure to complete a thorough annual Risk Analysis and follow the resulting Risk Management Plan could be fatal to your business. Unfortunately, HIPAA Rules do not explain how to do it. Office for Civil Rights’ (OCR’s) limited 9-page guidance document refers organizations to technical procedures in manuals and is geared to “the computer security community.” Several Federal “Security Risk Assessment Tools” are available, but they are incomplete and cumbersome. The Office for Civil Rights (OCR), the HIPAA enforcement arm of the U. S. Department of Health and Human Services (HHS) considers the most serious, most widespread HIPAA deficiency for covered entities and business associates – surpassing all others – to be organizations failing to perform a HIPAA Risk Analysis and implement a Risk Management program to address risks.
